Please read the full agreement carefully before signing.
Pets are living animals that require proper care, attention, financial commitment, and respect. By purchasing or placing a deposit on any animal from NJ Exotic Pets, the purchaser acknowledges and agrees to the following terms and conditions:
1. Purchaser Responsibility
The purchaser represents and warrants that: they are at least eighteen (18) years of age and legally capable of entering into this agreement; they have researched the animal and understand the care requirements, housing needs, dietary requirements, and long-term responsibilities associated with ownership; the animal is legal to own in the purchaser's city, county, and state; no member of the household, landlord, homeowners association, or governing authority prohibits ownership of the animal; and the purchaser understands that pets are not disposable and are a long-term commitment.
NJ Exotic Pets shall not be responsible for issues arising from landlord disputes, parental objections, allergies, relocation, financial hardship, incompatibility, or lack of interest.
2. No Guarantees / Assumption of Risk
Live animals are inherently unpredictable and may develop illnesses, behavioral issues, parasites, stress-related conditions, injuries, or dermatological conditions after purchase, including despite proper care.
Except where prohibited by law, all animals are sold "AS IS" without warranties or guarantees of any kind, express or implied, including but not limited to warranties of health, temperament, merchantability, fitness for a particular purpose, longevity, breeding capability, or compatibility.
The purchaser voluntarily assumes all risks associated with ownership, handling, transportation, housing, feeding, and care of the animal after purchase.
3. Veterinary Examination Policy
The purchaser has three (3) calendar days from the date of purchase to have the animal examined by a licensed veterinarian at the purchaser's sole expense. If a licensed veterinarian determines within that three-day period that the animal suffered from a pre-existing medical condition rendering the animal medically unfit for sale, the purchaser must: notify NJ Exotic Pets immediately; provide written veterinary documentation; and return the animal to NJ Exotic Pets for evaluation.
Upon verification, NJ Exotic Pets may, at its sole discretion, provide store credit equal to the purchase price of the animal OR a replacement animal of comparable value. No cash refunds shall be issued unless otherwise required by law. NJ Exotic Pets reserves the right to obtain a second opinion from a veterinarian of its choosing before issuing any remedy.
NJ Exotic Pets shall not be responsible for illnesses, injuries, deaths, or complications caused by improper husbandry, neglect, mishandling, transportation stress, environmental conditions, interaction with other animals, failure to follow care instructions, or failure to seek prompt veterinary care.
4. Returns / Surrenders
If the purchaser is no longer able to properly care for the animal, NJ Exotic Pets may accept the animal back solely on a voluntary surrender/donation basis. Acceptance is entirely at the discretion of NJ Exotic Pets and subject to available space, appropriate species accommodations, health and safety considerations, and surrender with a proper enclosure when required.
NO REFUNDS, STORE CREDITS, OR COMPENSATION SHALL BE PROVIDED FOR SURRENDERED ANIMALS. NJ Exotic Pets reserves the right to refuse any surrendered animal for any reason.
5. Deposits / Holds
All deposits are NON-REFUNDABLE and NON-TRANSFERABLE. Animals placed on hold with a deposit must be picked up within three (3) calendar days unless otherwise agreed in writing by NJ Exotic Pets. Failure to pick up the animal within that period may result in forfeiture of the deposit, and NJ Exotic Pets reserves the right to sell the animal to another customer without further notice.
6. Limitation of Liability
To the maximum extent permitted by law, NJ Exotic Pets, its owners, employees, affiliates, agents, volunteers, successors, assigns, and business partners shall not be liable for: veterinary expenses, emotional distress, incidental damages, consequential damages, loss of companionship, property damage, injuries, allergic reactions, bites or scratches, escaped animals, or any other damages arising from ownership or interaction with the animal. In any event, the maximum liability of NJ Exotic Pets shall not exceed the original purchase price paid for the animal.
7. Arbitration Agreement / Class Action Waiver
By signing this agreement, the purchaser agrees that any dispute, claim, or controversy arising out of or relating to the purchase, sale, condition, health, care, or ownership of the animal shall be resolved exclusively through binding confidential arbitration or mediation in the State of New Jersey. The purchaser waives any right to file or participate in a lawsuit in court, participate in a class action, collective action, or representative proceeding against NJ Exotic Pets or its affiliates. Each claim must be brought individually.
8. Non-Disparagement
The purchaser agrees not to knowingly publish or communicate false, misleading, defamatory, or malicious statements about NJ Exotic Pets, its owners, staff, or affiliates online or to third parties. Nothing in this agreement prohibits the purchaser from expressing truthful opinions, providing honest reviews, or communicating facts protected under applicable law.
9. Governing Law
This agreement shall be governed by and interpreted under the laws of the State of New Jersey without regard to conflict-of-law principles. If any provision of this agreement is found unenforceable, the remaining provisions shall remain in full force and effect.
By signing, the purchaser acknowledges that they have read, understand, and agree to all terms and conditions set forth in this agreement.
